Terms of use

Welcome to Binja. Binja is a digital platform designed to help people discover rental accommodation, request viewings, manage roommate preferences, and organise rent or bill related information. By using Binja, you agree to these Terms of Use. If you do not agree, you should not use the platform.
1. What Binja does
Binja helps users search for rental listings, connect around housing opportunities, request viewings, compare roommate preferences, and manage housing related information.
Binja is a platform. Unless we clearly say otherwise in writing, Binja is not a landlord, property owner, property manager, real estate agent, property broker, legal adviser, financial adviser, or payment institution.
2. Your account
You are responsible for keeping your account details accurate and secure. You must not share your login details with others or use another person’s account without permission.
You must provide accurate information when creating a profile, requesting a viewing, posting a listing, or contacting another user.
3. Age requirement
Binja is intended for users aged 18 and above. By using Binja, you confirm that you are at least 18 years old.
4. Listings
Listing owners, landlords, agents, and other users who upload listings are responsible for making sure that their listings are accurate, lawful, current, and not misleading.
A listing must not contain false prices, fake photos, unavailable properties, hidden charges, discriminatory wording, copied content without permission, or information that could mislead users.
Binja may review, edit, restrict, suspend, or remove listings that appear to be illegal, misleading, unsafe, fraudulent, discriminatory, or against these terms.
5. Landlords, agents, and property intermediaries
If you act as a landlord, agent, property broker, property consultant, or other property intermediary, you are responsible for complying with all laws and licensing rules that apply to you.
Where Maltese law requires a property intermediary to hold a licence, it is your responsibility to hold and maintain that licence.
6. Rental agreements and lease registration
Binja does not create rental contracts for users unless a specific contract feature is clearly provided. Users, landlords, agents, and property owners are responsible for reviewing rental terms, signing valid agreements, and meeting any lease registration obligations that apply.
Before paying money or signing an agreement, users should verify the property, the person offering it, the agreed rent, deposits, bills, and the registration requirements that may apply.
7. Payments, deposits, rent, and bills
Unless Binja clearly launches a payment service, Binja does not collect rent, deposits, agent fees, or bill payments on behalf of users.
Any rent, deposit, bill, or payment arrangement made outside Binja is between the relevant users, landlord, agent, or service provider.
Do not send money to anyone you have not verified. Be careful with urgent payment requests, overseas accounts, gift cards, crypto payments, or requests to pay before seeing enough proof.
8. User conduct
You must not use Binja to scam, harass, threaten, discriminate, impersonate others, upload illegal content, post fake listings, scrape data, interfere with the platform, or misuse another user’s personal data.
You must not upload content that you do not have the right to use.
9. Reporting content
Users can report listings, accounts, messages, or content that appear illegal, fraudulent, unsafe, discriminatory, misleading, or against Binja’s rules.
Binja may review reports and take action, including removing content, limiting visibility, suspending accounts, or contacting relevant authorities where necessary.
10. Content moderation and account action
Binja may remove or restrict content and may suspend or close accounts where we believe there has been misuse, risk to users, breach of these terms, or legal concern.
Where appropriate, users may contact us to request a review of a moderation decision.
11. No guarantee
Binja does not guarantee that a property is available, that a listing is accurate, that a user is trustworthy, that a viewing will happen, or that a rental agreement will be completed. Users are responsible for carrying out their own checks before making housing decisions.
12. Intellectual property
The Binja name, design, logo, interface, and platform content belong to Binja or its licensors. You must not copy or reuse them without permission.
You keep ownership of content you upload, but you allow Binja to use it where necessary to operate, display, improve, and promote the platform.
13. Limitation of liability
Binja is provided on an as is and as available basis. We aim to provide a useful and reliable service, but we do not promise that the platform will always be error free or uninterrupted.
To the maximum extent permitted by law, Binja is not responsible for losses caused by user conduct, third party listings, off platform payments, unavailable properties, inaccurate listing details, or agreements made outside the platform.
14. Changes to these terms
We may update these terms when the platform changes or where legal, security, or operational reasons require it. The updated version will be posted on this page.
15. Governing law
These terms are governed by the laws of Malta, unless a different rule applies by mandatory law.
